In an effort to try and get him out of serving jail time for his DWI arrest last month, Congressman Vito Fossella has hired the same ex-NYPD investigators that were employed by O.J. Simpson and John Gotti during felony cases, according to a published report.
The Daily News is reporting in Thursday’s editions that Fossella (R-Staten Island/Brooklyn) has hired private investigators James Harkins and John McNally, who are reportedly interviewing employees are the Logan Tavern, the Washington, D.C., watering hole Fossella was last seen at before being busted for DWI.
According to the report, Fossella has hired the duo in light of questionable readings of his breathalyzer test on the night of his arrest. The News is reporting that when he took a field sobriety test at midnight he blew a .13, lower than the standard of .15 that requires operators to serve a mandatory five-day jail term, but still higher than the state’s legal limit of .08. But he later blew a .17 around 3 a.m. only after a second test was ruled to be invalid. Fossella is due in a Virginia court on June 27.
One of Fossella’s lawyers, Barry Pollack, told the News that the circumstances around Fossella’s test results, “raise questions about the validity of that result.” Fossella’s people have also contended that cops went the extra mile to prove he was drunk because of his status as a US congressman.
Fossella’s lawyers have already called into question the accuracy of the Intoxilyzer 500, which was used by Virginia police at the time the congressman was stopped.
